Texas Sovereignty Act Receives TNM Endorsement

In another legislative endorsement, the Texas Nationalist Movement has given its support to House Bill 2338, the Texas Sovereignty Act.

The Texas Sovereignty Act creates a Texas-centered mechanism to review federal laws and end state cooperation with enforcement of those laws determined to violate the constitution and the sovereignty of Texas. This process would create a process to effectively block some federal laws and acts that are onerous to Texans.

Introduced by State Representative Cecil Bell, the legislation would form a permanent standing committee to review federal laws, agency rules and regulations, executive orders, federal court decisions and treaties.

Under the proposed law, if the committee determines a federal action violates the Constitution, both the full House and Senate would then vote on that determination. Passage of the resolution and the governor’s signature would constitute an official determination of unconstitutionality and would prohibit state enforcement of the act.

HB2338 tasks the state attorney general with “defending the state and its citizens to prevent the implementation and enforcement of a federal action declared to be an unconstitutional federal action.” This includes prosecution of any person who attempts to enforce such a federal action.

In lieu of legislation this session giving Texans a real vote on our independence, this legislation sets the stage to expose the overreach of the Federal Government and, in our opinion, creates the context under which a referendum on Texas independence becomes inevitable. This merits the support of every Texan who wants to push back against Federal overreach and supports an eventual vote on independence.
